Terms of Service

These Terms of Service ("Terms") govern your access to and use of Linkycat (available at linkycat.me), a link-in-bio service operated by Umisto ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Linkycat, you represent that you are at least 13 years old (or the age of digital consent in your country, if higher), that you have the legal capacity to enter into a binding agreement, and that you agree to comply with these Terms and all applicable laws and regulations.

2. Your Account

2.1 Registration

To use Linkycat, you must create an account with a valid email address and a unique username (handle). You are responsible for keeping your credentials secure and for all activity that occurs under your account.

2.2 Usernames

Your username forms part of your public profile URL (linkycat.me/@yourhandle). We reserve the right to reclaim or reassign usernames that are squatted, misleading, or reserved for system use.

2.3 Account Security

Notify us immediately at [email protected] if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain password security.

3. Subscriptions, Billing & Refunds

3.1 Plans

Linkycat offers a permanently free plan ("Free") and a paid subscription ("Pro"). We reserve the right to modify plan features with at least 14 days' notice to existing subscribers.

3.2 Merchant of Record — Paddle

All paid subscriptions are sold and fulfilled by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. By purchasing a Pro subscription, you are entering into a contract of sale with Paddle, not Umisto. Paddle is responsible for:

  • Processing your payment and issuing receipts
  • Calculating, collecting, and remitting applicable sales taxes and VAT
  • Handling payment disputes and chargebacks
  • Complying with applicable payment regulations

Paddle's own terms of service are available at paddle.com/legal/checkout-buyer-terms and apply to all purchases. We provide Paddle with your email address and subscription details necessary to complete your purchase. Paddle's privacy policy is available at paddle.com/legal/privacy.

3.3 Pricing

Current pricing is listed on our Pricing page. All prices are displayed in US Dollars (USD) unless otherwise stated. Paddle may display prices in your local currency at checkout; the displayed amount includes any applicable taxes. We reserve the right to change prices; any price change will be communicated to active subscribers at least 30 days in advance and will take effect at the next renewal date.

3.4 Billing Cycle & Automatic Renewal

Pro subscriptions are available on a monthly or yearly billing cycle. Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. Paddle will charge the payment method you provided at the start of each billing period. You can manage your subscription and view upcoming renewal dates from Settings → Billing.

3.5 Cancellation

You may cancel your Pro subscription at any time by going to Settings → Billing → Cancel subscription, or by contacting us at [email protected]. Cancellation is effective at the end of the current billing period — you retain full Pro access until that date and will not be charged again thereafter.

3.6 Refund Policy

Because Paddle acts as the Merchant of Record, all refund requests are processed by Paddle on our behalf under the following policy:

New Subscriptions — 7-Day Money-Back Guarantee

If you are not satisfied with your Pro subscription, you may request a full refund within 7 days of the initial purchase date. This guarantee applies to first-time purchases of each plan type; it does not apply to renewals or plan switches. To request a refund under this guarantee, email us at [email protected] with the subject line "Refund Request" and include the email address used at checkout. Approved refunds are typically processed within 5–10 business days and returned to your original payment method.

Renewals

Subscription renewals (monthly or yearly) are generally non-refundable once charged. However, if you contact us within 7 days of a renewal charge and were unaware your subscription was set to renew, we will review your case and may issue a full or partial refund at our discretion. To avoid unwanted renewals, cancel your subscription before the renewal date from Settings → Billing.

Yearly Subscriptions — Prorated Refunds

For yearly plans, if you cancel within the first 30 days of a billing period (initial purchase or renewal), you may request a prorated refund for the unused portion of the year. After the 30-day window, refunds for unused time on yearly subscriptions are issued at our sole discretion.

Plan Downgrades and Switches

If you switch from a yearly plan to a monthly plan, or from Pro to Free, any remaining subscription credit is applied as a prorated adjustment toward your next billing cycle where applicable. We do not issue cash refunds for plan downgrades unless required by applicable law.

Non-Refundable Circumstances

The following are not eligible for refunds:

  • Subscriptions cancelled after the 7-day money-back guarantee period (for initial purchases)
  • Renewal charges more than 7 days after the renewal date
  • Accounts terminated for violations of these Terms (Section 12)
  • Partial use of Pro features (e.g., using analytics for 20 days)

How to Request a Refund

To request a refund, contact us by either:

  • Email: [email protected] — include your account email, the approximate purchase date, and the reason for your request
  • Using the Paddle customer portal link in your receipt email — Paddle can process eligible refunds directly

We aim to respond to all refund requests within 2 business days. Approved refunds are issued to the original payment method within 5–10 business days. Where mandatory consumer protection law in your jurisdiction provides for longer refund windows or additional rights (for example, the EU 14-day cooling-off period for digital services where service delivery has not yet begun), those statutory rights apply and prevail over the above.

Consumer Rights — EU & UK

If you are a consumer located in the European Union or the United Kingdom, you may have a statutory right of withdrawal for a period of 14 days from the date of purchase, provided you have not accessed or used the Pro features during that period. By proceeding through checkout and clicking "Subscribe", you expressly request that we begin delivering the Pro service immediately, and you acknowledge that you thereby waive your right of withdrawal once the service has commenced. This does not affect any other rights you may have under applicable consumer law.

4. Acceptable Use

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful purposes, subject to these Terms.

4.2 Prohibited Content and Conduct

You must not use Linkycat to:

  • Violate any applicable law, regulation, or third-party right.
  • Post, link to, or distribute content that is harmful, abusive, defamatory, harassing, obscene, or otherwise objectionable.
  • Distribute malware, phishing pages, spam, or any content designed to deceive, defraud, or harm others.
  • Infringe the intellectual property rights of any third party, including publishing links to pirated content.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Interfere with or disrupt the Service or its infrastructure, including via denial-of-service attacks or excessive automated requests.
  • Attempt to gain unauthorized access to any part of the Service or another user's account.
  • Harvest or scrape user data, links, or other information from the Service without our prior written consent.
  • Use the Service in any manner that promotes illegal discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

5. User Content

5.1 Your Content

You retain ownership of content you add to Linkycat (your links, display name, bio, avatar, and profile page). By using the Service, you grant us a worldwide, royalty-free, non-exclusive license to host, display, and distribute your public profile page as necessary to provide the Service.

5.2 Our Right to Remove Content

We reserve the right to remove any content that violates these Terms or that we reasonably believe is harmful, without notice. Repeat violations may result in account suspension or termination.

5.3 DMCA / Copyright

If you believe content on Linkycat infringes your copyright, please contact us at [email protected] with a description of the claimed infringement and your contact information. We will respond in accordance with applicable law.

6. Intellectual Property

All non-user content on the Service — including the Linkycat name, logo, design, code, and copy — is owned by or licensed to Umisto and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your personal data as described in that policy.

8. Third-Party Services and Links

Linkycat allows you to link to third-party websites and services. We do not endorse, control, or take responsibility for any third-party content or services you link to. Accessing third-party services is at your own risk and subject to their own terms and privacy policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UMISTO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above may not apply to you. Where mandatory consumer protection law applies, that law prevails.

11. Indemnification

You agree to indemnify, defend, and hold harmless Umisto and its affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, or if required by law. You may delete your account at any time from your Settings page. Upon termination, your public profile and links will be removed. Any Pro subscription will be canceled at the end of the current billing period; no refunds are issued upon termination for breach of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify registered users by email or via a prominent in-app notice at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service before the effective date.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Umisto is incorporated, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any dispute arising from these Terms or the Service, except where mandatory consumer protection law in your country provides otherwise.

EU and UK consumers: Nothing in these Terms affects your right to bring claims before the courts of your country of residence or to use alternative dispute resolution schemes available under applicable law. Note that because Paddle is the Merchant of Record, payment disputes and billing-related claims should be directed to Paddle in the first instance via the contact details in your receipt.

15. Miscellaneous

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Umisto regarding the Service.
  • Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
  • No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
  • Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor entity in connection with a merger or acquisition.
